The Merehaven settlement

The controller will be replaced. The heat will continue. For six months, the parties agree on who pays without agreeing on who inherits.

01 / Instrument accepted

Aven and the Trust signed an interim service instrument on 24 June. Aven will carry M-4 into its replacement controller on 30 June as an explicit, bounded exception. The reservation ceiling remains 180 kW. This is an operating limit, not a promise of constant delivery or a technical finding about the building’s needs.

02 / Costs assigned

Aven will fund the controller replacement and maintain the exception. The Trust will pay for metered heat at the ordinary service tariff from 1 July through 31 December. The parties retain their respective positions on the earlier service entitlement; neither invoices nor this interim payment establish succession. RAMURAN’s protected reserve will meet the fixed fee for one further documentary review. It will not subsidize heat or underwrite an unlimited search.

03 / A decision with a date

The parties will review the service arrangement by 15 December. The interim instrument ends on 31 December and has no automatic renewal. Before expiry, Aven must issue an explicit continuation or retirement decision and give the Trust the notice required by the instrument. Failure to establish succession is not, by itself, a command to stop heat. There is no automatic disconnection scheduled by this record.

04 / Authority retained

Aven retains operating authority. The Trust retains responsibility for the uses of the building. RAMURAN can certify what its review establishes and nothing further. The agreement creates no institutional control channel and no permanent right for RAMURAN to inspect the site. Its temporary review access expires when the commissioned work is delivered.

05 / Verification before release

Aven’s completion notice records the controller replacement on 30 June. A joint reading on 2 July confirms that the protected branch remained in service after migration. The old controller was removed. Its obligation schedule was retained with the settlement file. The maintenance action is closed. Succession to M-4 remains unresolved as of this release.

06 / Positions at closure

Orrel records a successful replacement and a finite commitment. Eide records the separation of an obsolete machine from a still-useful constraint. Noll records an unresolved beneficiary and an improved recovery process. These are compatible observations. They are not an agreed account of who should have carried the cost.
